It has taken eight years, but McDonald’s could not carry the day against an Indian-owned restaurant in Kuala Lumpur called McCurry.
The American fast-food chain was suing against the use of the ‘Mc’ prefix but could not convince Kuala Lumpur’s federal court which ruled against it because McCurry was not a burger restaurant and not an imposter of the McDonald’s format. Owner P Suppiah says ‘McCurry’ is an abbreviation for Malaysian Chicken Curry.
McDonald’s won an early round in 2006 when the high court ruled in its favour. It was subsequently overturned in the court of appeal. The case reached Malaysia’s highest court, the federal court, which unanimously ruled today in favour of McCurry.
